Federal states with laws on PV roofing for parking spaces.


Climate protection is now changing the building laws. The federal and state governments are currently discussing the introduction of mandatory PV in new buildings and parking lots. In some federal states, a new state building code for sustainable building has been passed, which stipulates a PV obligation for certain new buildings from January 1, 2022.

Hessen:
Hessen decides to make photovoltaics mandatory for new parking spaces. The state’s new energy law now stipulates photovoltaic systems for areas with 50 parking spaces or more, as well as for state-owned buildings. As soon as new parking lots have more than 50 parking spaces, the photovoltaic obligation now applies in Hessen.

Niedersachsen:
From January 1, 2023 for the construction of an open parking lot or parking deck with more than 50 parking spaces for motor vehicles. Excluded from the obligation are parking spaces that are located directly along the carriageways of public roads and are dedicated to public traffic.

Nordrhein-Westfalen: Solar obligation for solar carports “with immediate effect” or January 1, 2022.
Photovoltaic systems are mandatory “with immediate effect” for newly built open and commercial parking spaces with more than 35 spaces in Nordrhein-Westfalen. Parking areas belonging to residential buildings are exempt from this. According to the new state building regulations adopted on June 30, 2021, this applies to all applications for planning permission received by the building supervisory authority in Nordrhein-Westfalen from January 1, 2022.

Baden-Württemberg:
With §8b, there is an obligation to install photovoltaic systems on parking lots. When building a new open parking lot suitable for solar use with more than 35 parking spaces for motor vehicles, a photovoltaic system must be installed above the parking space suitable for solar use if the application for planning permission is received by the responsible building authority from January 1, 2022.

Following an amendment to the law on October 15, 2021, the solar obligation for open parking spaces was reduced from 75 to 35. This means that the solar obligation for open parking spaces in Baden-Württemberg applies from 35 parking spaces.

Schleswig-Holstein:
planned from 2025

Rheinland-Pfalz:
The law stipulates that commercially used open parking spaces with a parking space size of 50 vehicles or more must be operated with a covered solar carport solar system. The solar obligation applies from 1 Jauar 2023.

PV obligation for certain new builds


An innovative regulation now applies to new non-residential buildings: Parking spaces must be covered with photovoltaic systems if they exceed a specified number of parking spaces.
